REF · REFUSED & COMPLEX

First application refused.
Now we read what IRCC actually said.

GCMS notes, procedural fairness letters, misrepresentation findings, restoration of status - complex files need someone who reads what the officer wrote, not just what the refusal letter says.

THE LANDSCAPE

What's actually
happening right now.

A quick read of the policy weather before we open your file - so the strategy fits the ground you're standing on.

Updated for 2026 policy
01 / 02

Every IRCC refusal letter is a two-line generic paragraph. The actual reasons - the officer's notes, the credibility findings, the flagged inconsistencies - live in GCMS notes obtained through an ATIP request.

02 / 02

Reapplying without ordering and reading those notes is the fastest way to get refused a second time on the same grounds. Every complex file we take starts with an ATIP.

WHO THIS IS FOR

Eligibility, in plain English.

Any recent IRCC refusal

Study, work, visitor, PR, sponsorship, or citizenship. We handle the analysis and reapplication for each.

Procedural fairness letter (PFL)

IRCC has flagged an issue (misrepresentation, credibility, eligibility) and given you a window (often 7–30 days) to respond. Miss it and the refusal is nearly automatic.

Misrepresentation finding

Serious - carries a 5-year bar. We assess whether it's a fightable interpretation or a factual dispute, and what remedies remain (H&C, PRRA, judicial review referral).

Restoration of status

If you lost status in Canada within the last 90 days, restoration is often paired with the reapplication.

HOW WE WORK

Four phases. No handoffs.

4 phases · one RCIC
01PHASE 01

ATIP / GCMS notes request

Full ATIP for GCMS notes on the refused file. This is where the real reasons live - and where the next file starts.

001
02PHASE 02

Refusal analysis

We map every reason cited in the notes to a specific evidentiary fix. You get a written analysis before we file anything new.

002
03PHASE 03

Strategy: reapply vs alternative

Sometimes a straight reapplication is right. Sometimes it's a different program (visitor record instead of TRV, PNP instead of general EE, H&C instead of standard PR). We recommend based on the notes, not the fee.

003
04PHASE 04

Refile & manage

New application built to address every previous ground of refusal, plus a written explanation letter tying it all together for the reviewing officer.

WHERE FILES FAIL

The three pitfalls we see most.

Reapplying without reading GCMS notes

The refusal letter is not the reason. Filing a "stronger" version of the same file usually gets refused for the same undisclosed reason.

Ignoring a procedural fairness letter

A PFL is not a refusal - it's your chance to respond before one. Every day counts. If you've just received a PFL, contact us today.

Self-diagnosing misrepresentation

Not every inconsistency is misrepresentation. Not every misrepresentation finding is unappealable. This is not a category to guess at.

QUESTIONS WE GET

Straight answers.

How long do GCMS notes take to arrive?+

Typically 30–45 days from ATIP submission. We can expedite in narrow circumstances (e.g., a PFL response deadline) but generally it's the pace-setter for a reapplication timeline.

Can I reapply immediately after a refusal?+

You can - but you shouldn't, until you know the actual reasons. The one exception is when a deadline (like an expiring status) forces a parallel filing while you order notes.

I have a 5-year misrepresentation bar. Is there anything I can do?+

Sometimes. Humanitarian & Compassionate applications, judicial review referrals, and specific narrow exceptions exist. It requires an honest assessment of your file, which starts with the GCMS notes.

CLIENT SNAPSHOT

Applicant from India, refused a visitor visa on grounds of insufficient home-country ties and unclear purpose of travel.

GOAL

Obtain a visitor visa to visit family in Canada.

THE CHALLENGE

A prior refusal on file meant every weakness would be scrutinized. The officer's concerns had to be answered before they were re-asked.
